Cork County Council Welcomes High Court Order to an East Cork Developer to Deconstruct Unauthorised Development and Reinstate Land
Cork County Council appreciates the High Courts decisive action in response to complaints about an unauthorised development in East Cork, as the newly established Planning and Environment Court orders the developer to deconstruct the unauthorised structures and reinstate the land within 100 days, reinforcing the court’s commitment to addressing such matters promptly.
Cork County Council sought an injunction from the Planning and Environment Court under S160 of the Planning and Development Act 2000(as amended) to cease all works on the site following receipt of complaints of alleged unauthorised development and the subsequent inaction following the issuance of Warning letters to the developer. This new division of the High Court, established on 11th December 2023 heard the matter on 19th and 21st of December. This case was one of the first to be heard by the Court.
The swift hearing of the matter by the Court emphasises the seriousness that the Courts place on instances of alleged unauthorised development. At a hearing on 21st December the Court issued a consent Order compelling the developer to, within 100 days, deconstruct the unauthorised development and reinstate the land. A significant step in upholding planning regulations and addressing concerns raised by the community.
